Legal notice
Security & Privacy
This policy applies to the processing of personal data that Power Toys AB ("POWERTOYS" or "we") collects about you, which may come, for example, via our websites (including third-party social networks), email, SMS, telephone, in-store interactions, registration forms, other contacts with us, CCTV surveillance, third parties, and publicly available information.
We value your personal privacy. This policy governs how we collect, use, and protect your data and how you can exercise your rights. Please contact us if you have any questions or comments regarding this privacy policy.
With reference to EU law, we refer below to the General Data Protection Regulation (GDPR) and other applicable Swedish data protection legislation.
What data do we collect about you?
"Personal data" refers to information relating to you that can identify you.
In this privacy policy, the terms "personal data" and "information about you" are used interchangeably.
You can usually use our website without providing us with any information other than technical data. On certain pages, information from you will be requested, for example in connection with purchases, service matters, or if you register to receive electronic newsletters. We may also use information about you obtained from other sources provided by third parties, such as marketing and sales activity companies.
The personal data collected about you may include:
Personal and contact information – such as your name, address, email address, and phone number, demographic data (such as date of birth, age, gender, geographic location, favorite products, and leisure interests), and, when clearly justified based on the purpose of processing or the importance of secure identification, also your personal identity number.
Financial information – information required to complete an order or that you use to make a purchase, such as payment or credit card details.
Technical information about your device or internet connection – such as IP address, cookies, geographic location, and login details.
Information about your usage behavior – such as your search patterns and activities on the website, page response times, and how you use our services.
User-generated information – content you voluntarily register, submit, or publish, for example in connection with customer service calls (which may be recorded), competitions, newsletter subscriptions, and content you share with us by uploading it to our website or social networks (which you allow the network to share with us), such as text, video clips, and photographs.
Information from other sources – publicly available information or information from our partners that we obtain, for example, to keep your data up to date or to ensure payment security.
Purpose and legal basis
For our processing of your personal data to be lawful, there must be a legal basis, meaning that it is necessary to fulfill a contract with you, comply with a legal obligation, is based on a balancing of interests, or that you have given your consent to specific processing. Below are examples of the purposes for which we process your personal data and the legal bases for doing so.
POWERTOYS processes your personal data for various purposes. Primarily, POWERTOYS processes your data for the following purposes and based on the corresponding legal grounds:
One of our main purposes for collecting personal data is to fulfill our obligations to you as a customer, such as processing and delivering your orders, invoicing, providing customer service, and other commitments related to purchases of our products. For example, we may need to respond to your inquiries via customer service regarding your purchase, send you product safety information (e.g., if a product recall is required), and ensure compliance with legal requirements (such as accounting laws).
Legal basis: Performance of a contract (terms of sale) or legal obligation
Another primary purpose is to offer you good products and services through personalized services and to deliver better services with more relevant content. We use the data we collect to provide you with information about products you request, but also to better understand our customers. To achieve this, we conduct customer surveys, among other things. We also analyze data about our customers’ demographic and geographic conditions, interests, and behavior based on information obtained from our website or other services, so-called profiling. Customer and market analyses and processing for statistical purposes are carried out at an aggregated level and are not intended to identify individual customers.
Legal basis: Legitimate interest
We may use your data to send newsletters, inform you about new products, campaigns, offers, competitions, and other information about our products and activities via post, email, SMS/MMS, or telephone. We may therefore use your data for direct marketing, including profiling, provided that you have not instructed us otherwise. If you do not have a customer relationship with us or have not had one in the past twelve months, we will only use your data for electronic direct marketing if you have given your consent. Your personal data may also be used for interest-based advertising online via us or digital advertising networks we collaborate with, which in some cases may be tailored to your interests based on collected data (profiling).
You have the right at any time to object to the use of your personal data for direct marketing purposes by contacting us as described under the Contact section below or directly in our electronic communications.
Legal basis: Legitimate interest or consent (unless otherwise explicitly stated in connection with the collection of your personal data).
POWERTOYS’ legitimate interest in the above processing of personal data is to provide you with a better shopping and customer experience and to offer you personalized offers and other relevant information.
Information about cookies
We use cookies, electronic images, and similar tracking technologies on our website and in our email communications. For more information on how we use cookies and similar technologies, see our cookie information.
Who do we share your data with?
We process your personal data with the utmost care, and your data is only used by us and selected third parties.
Third parties that we engage to help operate our business (such as for customer surveys and mailings) are only permitted to use your personal data on our behalf and for the specific tasks they perform according to our instructions, acting as data processors. They are required to keep your personal data confidential and secure. Where required by law, you have the right to receive a list of such processors.
To provide better services and for marketing purposes, we may also transfer your personal data to third parties, often acting as independent data controllers, so they can perform services for us or you, such as address updates, postal or delivery services, insurance companies, banks/credit agencies, or digital advertising networks we collaborate with.
We may also disclose personal data in special cases, for example when we believe it is necessary to identify, contact, or take legal action against someone who may have violated the website or infringed on our rights or the rights of our customers or other visitors.
Transfers of personal data outside the EU/EEA require that the country has an agreement with the EU/EEA, is deemed to have adequate data protection laws, or that we have agreements with the third party requiring them to apply EU Commission-approved standard contractual clauses. You can find lists of approved countries and clauses on the EU Commission’s website and the Swedish Authority for Privacy Protection’s website.
Your rights
In accordance with the law, you have the right to request information about the personal data we hold about you after identifying yourself and clearly specifying what information you wish to access. Such a request must be made in writing, signed, and sent to the address listed under Contact below. We will respond as soon as possible and within one month. If we cannot fulfill your request, we will inform you and explain why.
If you believe your data is incorrect or incomplete, you have the right to request correction as prescribed by law. We will correct or update your data as quickly as reasonably possible.
You also have the right to request deletion of your data, restriction of processing, withdrawal of consent, and data portability as provided by law.
Please note that we may need to retain certain personal data in connection with deletion, withdrawal, or portability to fulfill legal or contractual obligations. We may also retain data where permitted by law to meet business needs.
You have the right to object to processing based on legitimate interests, including profiling. You also have the right to object at any time to processing for direct marketing purposes.
How long do we retain your personal data?
We retain your personal data only as long as necessary for the purposes outlined in this policy or as required by law or contract. Data is deleted or anonymized when no longer relevant.
How do we protect your data?
To prevent unauthorized access, use, alteration, destruction, or disclosure, we implement appropriate and reasonable security measures. These are intended to prevent unlawful processing and accidental loss or damage. POWERTOYS uses SSL (Secure Socket Layer), meaning your orders are encrypted. We are also certified by Trygg E-handel (Swedish Distance Selling Association) regarding security and trust for e-commerce.
If a personal data breach occurs, it will be reported to the Swedish Authority for Privacy Protection and to you as required by law.
